OVERVIEW Welcome to J-PULS! Throughout the site, the terms “we”, “us” and “our” refer to J-PULS. J-PULS offers this store and website, including all information, content, features, tools, products, and ordering services (collectively, the "Services") available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. J-PULS is powered by Shopify, which enables us to provide the Services to you.

By placing an order, you are making an offer to purchase. J-PULS reserves the right, in its sole discretion, to accept or decline your order for any reason. An order is not accepted until J-PULS confirms acceptance. We must receive and process payment before an order is accepted. Please review your order carefully before submitting, as J-PULS may not be able to accommodate cancellation requests after an order has been accepted. If we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail, billing address, and/or phone number provided at the time the order was made.

Purchases are subject to return or exchange only according to our Refund Policy [Link]. You represent and warrant that any products purchased are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICING AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise stated, posted prices do not include taxes, shipping, handling, duties, or import fees.

Prices posted on the online store may differ from prices offered in physical stores or other stores operated by third parties. We may offer promotions from time to time that may affect pricing and are governed by terms separate from these Terms. In the event of a conflict between promotion terms and these Terms, the promotion terms will prevail.

You represent and warrant that (i) the credit card information you supply is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including all shipping and handling charges and all applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY

We are not responsible for delays in shipping or delivery. All delivery timeframes are estimates and are not guaranteed. We are not liable for delays caused by shipping carriers, customs clearance, or events beyond our control. Title and risk of loss pass to you upon our transfer of the products to the carrier.

Our Services (including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement thereof) are owned by J-PULS, its affiliates, or licensors and are protected by United States and foreign patent, copyright, and other intellectual property laws.

You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without our prior written consent. Nothing in these Terms shall be construed as granting any license or right under any patent, trademark, copyright, or other intellectual property of J-PULS, Shopify, or any third party. Unauthorized use of the Services may violate federal and state intellectual property laws. All rights not expressly granted herein are reserved by J-PULS.

J-PULS's name, logo, product names, service names, designs, and slogans are trademarks of J-PULS or its affiliates or licensors. You must not use such marks without prior written permission. The Shopify name, logo, and related marks are trademarks of Shopify. All other marks on the Services are the trademarks of their respective owners.

SECTION 7 - OPTIONAL TOOLS

We may provide you with access to third-party tools as part of the Services which we neither monitor nor have any control or input over.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. SECTION 9 - RELATIONSHIP WITH SHOPIFY

J-PULS is powered by Shopify, which enables us to provide the Services to you. However, sales and purchases at the store are made directly by J-PULS. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales between you and J-PULS, including injuries, damages, or losses arising from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising out of or related to your purchases and transactions with J-PULS.

Additionally, you agree not to: (a) upload or transmit viruses or any other type of malicious code; (b) use any robot, spider, scraping, data gathering and extraction tools, or AI tools (such as agentic AI) to access the Services; or (c) interfere with or circumvent the security features of the Services. We reserve the right to terminate your use of the Services for violating any of the prohibited uses.

SECTION 14 - AGENTS

14.1 This section (“Agent Terms”) applies if you use, authorize, or deploy an Agent to access or interact with the Services. “Agent” refers to software or services that perform autonomous or semi-autonomous actions on behalf of a person or entity without direct supervision. 14.2 Agents may not access or use the Services unless they identify themselves and comply strictly with Section 14.4. 14.3 We may restrict Agent access through technical means. 14.4 Agents must: (i) identify themselves in all HTTP/HTTPS requests with a User-Agent string: "Agent/[Agent Name]"; (ii) not hide or obfuscate their identity or mimic human behavior (e.g., by bypassing CAPTCHAs); (iii) respond honestly to prompts intended to distinguish humans from computers; and (iv) not circumvent any blocks or restrictions intended to control Agent interaction.

We may terminate this agreement or your access to the Services at any time without notice, at our sole discretion. Upon termination, you remain liable for all amounts due up to and including the date of termination. Provisions that by their nature should survive termination (including Intellectual Property, Feedback, Disclaimer of Warranties, and Limitation of Liability) shall remain in effect.

To the maximum extent permitted by law, in no case shall J-PULS, our directors, officers, employees, affiliates, agents, contractors, or Shopify and its affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Services or any products procured using the Services.

SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless J-PULS, Shopify, and our affiliates, partners, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of (1) your breach of these Terms, (2) your violation of any law or the rights of a third-party, or (3) your access to and use of the Services.

SECTION 19 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the jurisdiction where J-PULS is headquartered. You and J-PULS consent to the venue and personal jurisdiction of the courts in such jurisdiction.
